CCI imposes Rs 5.91 billion penalty on CIL for discriminatory FSA conditions

The Competition Commission of India (CCI) has imposed a penalty of Rs 5.91 billion on Coal India Limited (CIL) on account of discriminatory fuel supply agreement (FSA) conditions forced by it on power producers for the supply of non-coking coal. The CCI has ordered CIL and its subsidiaries to “cease and desist” from anti-competitive practices and also asked the company to modify FSAs to ensure uniformity between old and new power producers as well as between private and state power producers. The order has been passed in response to requests filed by Maharashtra State Power Generation Company Limited and Gujarat State Electricity Corporation Limited.
