WBERC passes order of use of fossil fuel-based cogeneration for RPO compliance

The West Bengal Electricity Regulatory Commission (WBERC) has passed a suo-motu order regarding applicability of fossil fuel-based cogeneration on renewable purchase obligation (RPO) compliance in terms of judgement passed by Appellate Tribunal for Electricity (APTEL) on December 2, 2012 in Appeal no. 53 of 2012.

The commission observed that the existing regulations on co-generation and generation of electricity published by commission in March 2013 are in deviation from the findings of the APTEL. The commission has now ordered that henceforth any power purchase from fossil fuel-based cogeneration will not be counted for RPO compliance pending amendment of the said regulations in terms of the judgement. However, the distribution licensee may continue with the purchase from fossil fuel-based co-generation of power as an energy efficient measure.
